Your statutory rights are not affected by any of the following terms and conditions.
1. Price
All items on this web site are offered at the price shown on screen and are inclusive of United Kingdom VAT. Payment for goods may be by secure credit card transaction (Paypal) on this site or Credit/Debit cards via telephone. There are no additional charges applied to credit card purchases. Cheques should be made payable to "NEXT DAY FITNESS". All prices are correct at time of publication. Errors and omissions are accepted.
2. VAT
All items currently include VAT @ 17.5%.
3. Delivery
We only deliver to the United Kingdom mainland.
Scottish postcodes AD, DD, IV, KW & PH will incur a delivery surcharge, please contact us if you would like a delivery quote to these areas.
The items on our site are in stock and under normal circumstances will be dispatched on the next working day.
Delivery Failures - Depending on the method of delivery the following terms will apply to failed deliveries. (You will always be informed how we intend to deliver your order prior to its delivery).
Delivery by Parcel Courier (e.g Rowers, Cycles, Cross Trainers) - We or our nominated carrier will contact you to arrange a delivery date with you. Should you not be home when your order arrives, we will charge a re-delivery fee of £13. If we fail to deliver on the arranged date, we will waiver the £13 re-delivery fee.
Delivery by Pall-ex Pallet Delivery Service (e.g Large Treadmills, Multiple Items, Table Tennis Table) – Once the goods have been dispatched from our warehouse you will then receive a call from the courier to ensure you are in on the preferred date. Should you not be home when the courier arrives, the goods shall be returned to our warehouse and a failed delivery fee of £35 will be applied to your order, regardless of whether the order is re-delivered or cancelled. If the delivery failure is due to arrivel outside of the agreed time window, then the failed delivery fee will not be charged.
Please note that it is your responsibility to be home to accept delivery at the previously arranged date/time.
4. Cancellations
You may cancel your order at any time by contacting us via email or telephone. If your goods have not been dispatched, we will arrange for a refund via the same method you used to purchase the goods. If your order has been dispatched, you will also be charged for the costs of returning the goods to us. This charge is £30 and this will be deducted from any refund given. Unless the goods are faulty, we will not refund any delivery charges.
5. Day Cooling Off Period
Under the European Directive on distance selling (Which is incorporated into UK law by the Consumer Protection (Distance Selling) Regulations 2000), you have the unconditional right to cancel your order within 7 working days without having to give us a reason. The 7 working days start from the day after the day that you receive the goods at the designated delivery address. We will provide a full refund for the purchase price of the goods but not any delivery charges (If delivery has been made). In order for us to provide a refund, all goods must be unopened and in perfect condition. We unconditionally reserve the right to not refund if the goods are not returned in a suitable condition. Please note that if you exercise this right, you will have to pay the cost of returning the goods to us. This charge for returning goods is £40. Where you exercise this right to cancel, we undertake to refund your money within 7 days of receiving the goods back into our warehouse. In addition to the return delivery charges, we will not refund any delivery charges you may have incurred in receiving your goods. The only exception to this is if the goods are faulty, in which case we bear all the costs.
6. Refurbished Products
Refurbished products were once faulty items that have been restored to full working order by the manufacturer. Any malfunctioning parts (e.g. motors) are fixed or replaced, the product is then thoroughly cleaned and tested to make sure the it is working correctly and safe to use. These refurbished products are then carefully repackaged as new, ready for sale. Please be aware that a refurbished product may show very minor signs of pre-assembly. The refurbishing process is carried in full out by the manufacturer. All refurbished items are sold with manufacturer's warranty.
7. Returns - Defective Products
If you receive a faulty or defective item please contact the helpdesk telephone number of the manufacturer (found in the product's user manual). If the manufacturer's helpdesk is not able to offer satisfactory assistance please contact us and we will attempt to resolve the problem. In the unlikely event that both the manufacturer and ourselves are unable to resolve the problem we will provide a full refund for the total purchase price and will collect the goods at our cost. Please allow up to 14 days for faulty items to be repaired, replaced or refunded.

8. Warranties
Details of warranty are stated in the product description of each item.
9. Privacy
We respect your privacy by the enforcement of a strict company privacy policy. We will never contact you via unsolicited email. (In accordance with the Privacy & Electronic Communications Act passed into law 11 Dec 03). We do not send random marketing emails to personal email addresses.
10. Complaints & Correspondence
Complaints can be made via telephone, in writing to the address shown below. We will make every effort to respond to any complaints within 7 working days.
